1 Do I need to come to Spain to submit documents (business residence permit)?
Yes, this type of business residence permit is issued strictly in Spain. Initial submission of documents takes place entirely electronically, as long as you are legally in the country on a tourist visa or visa-free. You do not need to leave and wait for approval in your home country - you conduct the entire review process inside Spain.
2 How long does it take to register a business residence permit?
On average from 2 to 4 months: 3-4 weeks - preparation of a business plan, collection of personal certificates, sworn translation. from 1 to 3 months - the official deadline for consideration of the project by the business association and the migration service.
3 Is it possible to include a family in the application for a business residence permit?
Your spouse and minor children may be submitted with you in the same package. At the same time, the financial qualification for personal accommodation on the IPREM scale increases proportionally: an additional €7,200 is required for the second family member, and €3,600 for each child for the year ahead.
4 Is it possible to work remotely for a foreign company with this residence permit for business?
Officially not. This type of residence permit is issued strictly under the conduct of its own commercial activities as Autónomo in Spain. There should be no hidden employment contracts in the case. If your goal is exclusively remote work for the former employer, you are more suitable for a residence permit Digital Nomad.
5 Do I have to pay taxes in Spain for a business residence permit?
Yes, that's a basic duty. Once approved, you register as Autónomo and pay monthly social security contributions (Seguridad Social), as well as quarterly VAT returns (Modelo 303) and income tax (Modelo 130). The fact of doing business and paying taxes is the main condition for extending the residence permit.
6 Is normal travel insurance suitable?
Nope. An annual policy is required from a Spanish insurance company with full coverage, no deductibles and no surcharges for each visit (sin copagos). We cooperate with accredited insurance companies and select a policy that is guaranteed to be approved by migration services when checking your business case.
7 Who is a gestor and why do you need it after moving?
Hestor is your accountant and tax manager in Spain. For the business residence permit it is vital, as accounting IP (Autónomo), VAT calculation, filing quarterly declarations and accounting of company expenses require professional knowledge of Spanish tax legislation.
8 For how long is a business residence permit issued?
The first plastic card of a TIE resident is issued for a period of 1 year (after registration in tax and social insurance). When extending the status, if your business operates, generates income and you regularly pay taxes, the immigration service issues the next card for 2 years at once.
9 What is a Business Registration Obligation?
This is an official document replacing the declaration of refusal of work. You sign an application in Spanish, in which you undertake a legal obligation within 30 days after approval of the residence permit to officially register with the tax office (Hacienda) and launch the declared project.
